Post Rivera, Schaer commits to beefed up ethics training for Passaic

Five days into his service as acting mayor of Passaic, Gary SchaerPassaic Acting Mayor Gary SchaerPassaic Acting Mayor Gary Schaer pledged to remove the taint of corruption from a city whose former mayor pleaded guilty to extortion last Friday and resigned hours before Schaer assumed office.

"Throughout my over 18 years of service to Passaic, I have sought to serve with distinction and honor, always taking into account what is best for all of Passaic," said Schaer, 57, an investment analyst broker who served as commissioner of the Passaic Housing Authority for five years prior to his election to the council.

As the successor of Sammy Rivera, Schaer continues in his role as council president, and as the legislature’s first Orthodox Jewish assemblyman, now serving his second term in the 36th district.

The ironic presence of a framed portrait of Washington crossing the Delaware was not lost on two courtroom artists crouched over their easel with erasers and pastels Thursday. In their rendering, they took some license in centering the framed and famed heroic portrait of 12 men braving the elements over the heads of the 12 men in the docket, who crowded together, resembled another band of ragtag shipmates.

The trouble was they weren’t crossing the Delaware, but stranded this side of the river in handcuffs and leg-irons in Trenton’s Clarkson S. Fisher Federal Building, in the uncomfortable position of fighting off U.S. Attorney Christopher Christie.

Magistrate Judge Tonianne Bongiovanni acknowledged the charges of either conspiracy to extort corrupt payments or attempting to extort corrupt payments that Christie’s office brought against the men - 11 of them elected or former elected officials from Pleasantville to Passaic, among them dual-officeholder Mims Hackett, an Assemblyman and the Mayor of Orange, Assembly Deputy Speaker (and Passaic County Undersheriff Alfred Steele), and Passaic Mayor Sammy Rivera.

Schaer: Passaic deserves honest government

City Council President Gary S. Schaer said that he became aware of the arrests of Mayor Sammy Rivera, Councilman Marcellus Jackson and former Councilman Jonathan Sorto this morning.

“I have been in contact with the Administration and Business Administrator and I am confident that the business of the City will continue without interruption," Schaer said in a statement. "As City Council President, the Council and I will make every effort to ensure that Passaic residents will continue to receive the City services that they have come to expect.”

Alfred Steele is the Assembly Deputy Speaker and the Passaic County UndersheriffThe list of eleven public officials arrested today by FBI agents: Assemblymen Alfred Steele and Mims Hackett, Passaic Mayor Sammy Rivera, Passaic City Councilman Marcellus Jackson, former Passaic City Councilman Jonathan Soto, Keith Reid, the Chief of Staff to the Newark City Council President, Louis Mister of Pleasantville, and five current and former members of the Pleasantville Board of Education -- Jayson Adams, City Councilman Maurice "Pete" Callaway, James McCormick, James Pressley and Rafael Velez.

Callaway is the brother of former Atlantic City Councilman Craig Callaway, who was sentenced today to 40 months in a federal prison for taking bribes from an undercover FBI agent.

Soto, viewed as a rising star in North Jersey GOP politics when he was elected to the City Council in his early 20's, is the Passaic Republican Municipal Chairman.  He has endorsed Rudy Giuliani for President.

Schaer gets by ban on dual officeholding on a technicality

The resignation of Passaic Mayor Sammy Rivera following his guilty plea on federal bribery charges means that City Council President Gary Schaer will become the Acting Mayor.  That could mean an interesting test to a law passed last year that bans dual office holding because Schaer is also an Assemblyman.  Dual officeholders elected before February 2008 are grandfathered under the new law, allowing Schaer to serve as an Assemblyman and Councilman.  But now that Schaer has the powers that come with being Acting Mayor of Passaic, could he be violating the spirit of the ban on dual office holding?

Corzine's Atlantic dilemma

Democrats in Atlantic City, clearly nervous about the impact of AWOL Mayor Robert Levy on the fall campaigns for State Senate, Assembly and County Executive, want Governor Jon "Zero Tolerance" Corzine to get involved -- perhaps, it has been suggested, find a way to remove Levy from office.  But if Corzine did that, wouldn't he need to be held accountable for removing a resume embellesher with an unspecified illness while being unwilling to call for the immediate ouster of other indicted officials, like State Senators Sharpe James and Wayne Bryant, and Mayors Mims Hackett and Sammy Rivera?

Help Wanted: Lawyer with knowledge of U.S. Attorney

Less than a week after Passaic Mayor Sammy Rivera and Councilman Marcellus Jackson were arrested on bribery charges, City Council President Gary Schaer says the Council will hire an independent special counsel to review city contracts over the last two years. Schaer says he wants to hire a lawyer with “significant experience in matters before the U.S. Attorney.”

Arrests could be first test of Panter's ethics reform law

Today's arrests could be the first real test of Assemblyman Michael Panter's legislation (A-20), which requires mandatory prison sentences and pension forfeiture for any public officials convicted of corruption.  Governor Jon "Hold Me Accountable" Corzine signed the bill on March 16th of this year and it took effect on April 15th.  Criminal complaints filed today by the U.S. Attorney could mean that Assemblymen Alfred Steele and Mims Hackett, Passaic Mayor Sammy Rivera, Passaic Councilman Marcellus Jackson, and Keith Reid, the Chief of Staff to the Newark City Council President, would lose their pensions if convicted of bribery.
