VAS/CHIVUKULA/VAN DREW MILITARY EMPLOYMENT PROTECTION BILL SIGNED INTO LAW
(TRENTON) - Legislation Assemblymen Joseph Vas, Upendra Chivukula and Jeff Van Drew sponsored to protect enlisted military personal from losing employment when called to active military duty during a time of war or domestic emergency was signed into law today by Governor Jon S. Corzine.
"While American service men and women work hard every day to protect us, we owe them the option to return to their jobs when they finish their tours of duty," said Vas (D-Middlesex). "It's the least we can do to thank them for their service."
Under current law individuals who take a leave of absence from a civilian job to fulfill their military obligations entitle to protections that enable individuals to possibly resume their private sector employment.
The Vas/Chivukula/Van Drew measure (A-3622) would expand those protections by requiring employers to offer any position available for which a returning employee is qualified, if an original position was filled a service person's absence.
"There should be no questions asked about providing fairness in the workplace for individuals who are bravely serving our country," said Chivukula (D-Somerset). "They should not be penalized for fulfilling their duty."
"Our veterans shouldn't have to fight all over again for a job they already earned," said Van Drew (D-Atlantic/Cape May/Cumberland).
The new law takes effect immediately.
